For the record, we haven\u2019t heard of a single audit in\u00a0our neck of the woods! The compliance check would include review of SPD\u2019s\u00a0and Plan Documents, of which most employers do not actually have in place.<br \/>\nIn the past, the Plan descriptions and contracts provided by insurance\u00a0companies were believed to satisfy these requirements. However, due to\u00a0added provisions and health care reform they likely no longer suffice.\u00a0Should you comply? Well, yes of course you should, and the good news\u00a0is&#8230; we can help.<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">If you don\u2019t take action now, just keep in mind that if you are contacted\u00a0by the DOL, you have 30 days to provide the required documents, at which\u00a0point you should call either an ERISA attorney or your health insurance\u00a0consultants at DDI!<\/p>\n<p style=\"font-size: 22px; padding: 0px; font-style: italic; color: #e0601f; font-weight: bold; letter-spacing: 4px; text-transform: lowercase; font-family: Palatino, serif; line-height: 24px; margin: 8px 0px 8px 0;\"><a id=\"federal\" name=\"federal\"><\/a>Federal Compliance Alert:<br \/>\nSPD\u2019s and Plan Documents<\/p>\n<p><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" src=\"https:\/\/i0.wp.com\/ddibenefits.com\/newsletter\/images\/USDOL_Seal_circa_2015.svg.png?resize=144%2C144\" alt=\"us department of labor\" width=\"144\" height=\"144\" align=\"right\" \/><\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">Did you know that due to health care reform the Department of Labor\u00a0(DOL) has increased their focus on auditing all employee benefits plans,\u00a0including health and welfare benefits plans?<\/p>\n<p style=\"font-style: italic; font-size: 16px; line-height: 17px; color: #e0601f; text-align: left; font-family: Palatino, serif; font-weight: bold; margin: 8px 0px 8px 0;\">What\u2019s Required?<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">ERISA (the federal Employee Retirement Income Security Act) requires\u00a0employers of all sizes who are plan administrators of their group health\u00a0plans to comply with 2 important requirements or risk potential penalties\u00a0and possible audits:<\/p>\n<ul style=\"font-size: 12px;\">\n<li>Maintain and distribute Summary Plan Descriptions (SPDs) to plan\u00a0participants which accurately reflect the contents of the plan and\u00a0which include specific information as required under federal law.<\/li>\n<li>Group health plans must be administered in accordance with a written\u00a0Plan Document which must be made available to plan participants and\u00a0beneficiaries upon request.<\/li>\n<\/ul>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">Many companies mistakenly assume that insurance contracts, certificates\u00a0of insurance and benefits summaries fulfill the ERISA requirements for\u00a0an SPD and Plan Document&#8211;but they don&#8217;t include the required or recommended\u00a0provisions that protect the plan and the employer.
