Medicare D Notice and Filing Reminder<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">All\u00a0employers, large and small, who offer prescription drug coverage are required\u00a0to inform their employees and CMS if their prescription drug plan is medicare\u00a0creditable by October 15, 2016. This deadline is a result of the annual enrollment\u00a0period for Medicare which is October 15 \u2013 December 7th each year. Even if you\u00a0are unsure of medicare eligibility it is recommended to provide this notice\u00a0to your benefit eligible employees and their dependents.<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\"><a href=\"https:\/\/www.cms.gov\/Medicare\/Prescription-Drug-Coverage\/CreditableCoverage\/Model-Notice-Letters.html\">Please\u00a0click here<\/a> for the full explanation of the Medicare Modernization Act\u2019s requirements\u00a0as well as model notices of the required forms. Any members (including dependents)\u00a0who are eligible or will be eligible within the next year for Medicare must\u00a0receive the notice. Employers must also notify CMS via their online form as\u00a0to whether their plans are or are not creditable.<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\"><em><strong style=\"color: #e15f31;\">According\u00a0to CMS:<\/strong><\/em><\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">This disclosure must be provided to Medicare eligible active working individuals\u00a0and their dependents, Medicare eligible COBRA individuals and their dependents,\u00a0Medicare eligible disabled individuals covered under your prescription drug<br \/>\nplan and any retirees and their dependents. The MMA imposes a late enrollment\u00a0penalty on individuals who do not maintain creditable coverage for a period\u00a0of 63 days or longer following their initial enrollment period for the Medicare\u00a0prescription drug benefit.<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">Click\u00a0<a href=\"https:\/\/www.cms.gov\/Medicare\/Prescription-Drug-Coverage\/CreditableCoverage\/Model-Notice-Letters.html\">here<\/a> to download the model notice letters you can customize and send to employees.<\/p>\n<p style=\"font-size: 12px; line-height: 16px; margin-top: 8px; margin-right: 0px; margin-left: 0; color: #000; font-family: Palatino, serif;\">If\u00a0you are unsure whether your plan is creditable or not, please contact your\u00a0health insurance carrier or DDI.
